Gun Banners Seek to Amend Florida Constitution in 2020

Threat to Liberty

Gearing up for the 2020 election, anti-gun groups propose constitutional amendments that would obliterate the Second Amendment in the Sunshine State if 60 percent of the voters support it.

“I am personally taking this as a serious threat to our liberty,” said David Macfarlane, a U.S. Marine trained in marksmanship and security. “This is not just the right to keep and bear arms, it is a threat to every liberty.” Do not be tricked, he said organizers promoting the amendment proposals do not want to keep us safe, they want to confiscate our guns.

“I am most concerned about the kind of overreach that governments cannot do while the people are able to resist it,” said the Florida native. “If we are disarmed, there are many horrors that these same people will try to inflict upon us all and our options will be severely limited.”

While masked in hair-raising language and murky details, he said the amendment proposals are aimed at gun registration, surrender requirements, gun confiscation and banning of weapons altogether in violation of the Second Amendment and the U.S. Constitution.

Constitutional Violations

“By requiring the surrender of privately owned weapons, the proposed ban violates the 4th, 5th, and 14th Amendment protections against due process violations and confiscation of property,” said Macfarlane. “Historically registration has been used later by tyrannical governments to know who has weapons and target them for confiscation.”

By virtue of the 14th Amendment, he advises that Florida voters cannot amend their state constitution in a way that breaches the U.S. Constitution. “No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States and this is understood to mean that states cannot infringe upon any right that is respected at the federal level.”

Furthermore, he said the Second Amendment does not grant rights, as the anti-gun left suggests, it assumes that the right to keep and bear arms is an individual right that exists prior to the Second Amendment. “The Second Amendment is a prohibition against infringing upon that existing right.”

Florida ballot initiatives deceptively indicate that the right to keep and bear arms is not an individual right, but an exclusive right of a militia that they re-define as law enforcement or military, he continued.

“At the time the Second Amendment was written, there was no standing army or police force. So, in order to raise a fighting force in the amount of time needed, the people had to be armed and proficient with their own weapon,” said Macfarlane, who is also a Podcaster on AnchorFM. “The belief that the right to keep and bear arms is a right of the militia would be like thinking that the right to freedom of speech or freedom of the press only applies to people who work for the New York Times or CNN.” The law is clear that the militia is We the People, he said.

“The militia as defined by state and federal law is every able bodied citizen of a state,” said the self-described patriot  philosopher. “The Second Amendment is not asking if the militia is still necessary, it states that the militia is necessary in order to keep a state free.”

Violates Right to Self Defense

In addition, he said the constitutional initiatives’ attempt to stop the purchase of firearms that are more effective for self-defense makes us demonstrably less safe. “No one in a firefight ever says ‘I have too many bullets.’ What you want is the best most effective weapon that you can have and operate effectively. I have an M-4 with a 100 Round drum — that is an effective weapon.”  

Macfarlane, who is also a software consultant, said self-defense is a natural right no authority can subjugate. “These kind of people are the kind of people who think that force in support of official authority is always warranted but force used in support of an individual is never warranted.” If the anti-gunners have their way, he said perpetrators whether domestic or foreign will have their way too.

“As a consequence of this, men will be unable to protect their homes — especially in rural areas where police are far away,” he said. “As a consequence of this, women will be unable to defend themselves from rapists.”

In addition, he said certain people will be disallowed from possessing a firearm including those being investigated for domestic abuse twice, those who are the subject of a call to police twice, and those  who have their license suspended for speeding; all provisions that violate the 4th, 5th, and 14th Amendments.

“In Florida, we have already tried banning weapons in three areas: Schools, Bars and Airports,” said Macfarlane. “We have had mass shootings in three types of places: Schools, Bars, and Airports. This is not a solution, it is more of the root cause.”

While these anti-gun initiatives do not currently have the required signatures to gain 2020 ballot access, he expects that the anti-gunners will gain momentum and enough signatures. In the meantime, he said he will continue to expose the unconstitutional actions of the anti-gun left and its detrimental effects on American liberty.
